GUTS Terms and conditions

 

1. Definitions

1.1 Guts Extreme Adventure Africa Safaris cc 2003/077122/23- "Guts."

1.2 Person or persons who have signed the booking form- "Client."

2. Terms and Conditions

2.1 Upon signature the client agrees to be bound by these booking conditions.

2.2 Any contract between the client and Guts is subject to and shall be governed and construed according to South African law.

3. Booking

3.1 A signed and completed booking form must be sent to Guts or its agent together with a non-refundable deposit of 50% of the tour price. The balance of the tour fare must be paid 28 working days prior to the date of departure.

3.2 Guts will not accept any booking where the booking form has not been signed or is incomplete. A confirmation will be issued when Guts receives a signed Booking Form and the 50% deposit. Guts reserves the right to decline any booking.

3.3 Prior to full and final payment, Guts reserves the right to change any prices, services and departures without prior notice.

4. Language
4.1 All tours are conducted in English or Afrikaans for local clients.

5. Travel Insurance
5.1 Comprehensive travel insurance covering cancellation, curtailment, medical, emergency travel and personal accident is compulsory (advisable for local clients) on all tours. Insurance for loss of baggage, money or personal items is recommended.

5.2 The client accepts that it is his/her responsibility to arrange insurance.

6. Full payment of tour cost
6.1 Full payment of the tour cost must be received 28 working days prior to departure. If full payment is not timely received, Guts reserves the right to cancel the booking. Any bookings made within four weeks of departure must be accompanied by full payment of the tour cost.

7. Local Payment (if applicable)
7.1 The local payment is to be paid to the guide on the day of departure in US$ cash only. No traveller's cheques or other currencies will be accepted.

8. Cancellation or changes to Bookings
8.1 Cancellation of or changes to any booking must be received in writing and acknowledged by Guts.

8.2 In the event of cancellation, the following cancellation fees will be payable by the client:

  • Notification is received 28 days or more before departure, loss of 50% deposit.
  • 28 -21 working days, loss of 60% of tour cost
  • 20 -14 working days, loss of 80% of tour cost
  • 13 - 0 working days, loss of 100% of tour cost
  • If you fail to join a tour, join it after its departure, or leave it prior to its completion for any reason, no reimbursement will be made.

8.3 Changes made by you: If you need to change your reservation for whatever reason, Guts will make every effort to assist you subject to availability and agreement with our reservation office. Any changes will incur a fee of US$ 50 and any subsequent cancellation fee will be based on the original travel date. If alternative dates are unavailable, the normal cancellation fees will apply.

8.4 Guts reserves the right to change or cancel any tour although every effort will be made to operate itineraries as advertised.

8.5 In the event a tour is cancelled by Guts, the client may choose a full refund or alternatively any other available Guts tour. If the price of the alternative tour is less than the original tour booked, the difference will be refunded to the client. If the alternative tour is more expensive, then the client will be responsible for the additional cost.

9. Passport, visas and other travel documents
9.1 The client is responsible for ensuring that all documents, passport, visas and health certificates are valid.

9.2 The client accepts full responsibility for obtaining all required travel documents.

9.3 Should a client be refused entry to any country due to incorrect documentation, Guts will not be liable for any costs of such delays or repatriation cost to the client.

10. Baggage
10.1 All personal effects and baggage are at all times the clients’ responsibility and Guts will not accept liability for any loss or damage to baggage or personal effects.

10.2 Clients are entitled to one bag of not more than 15 kg and a small daypack. Guts reserves the right to refuse excess luggage. NO SUITCASES PLEASE.

11. Health
11.1 It is the responsibility of the client to consult a health professional with respect to recommended and compulsory vaccinations and health precautions. Any pre-existing medical condition must be declared at the time of booking and the client must make arrangements for the provision of drugs or other treatment that may be required during the tour.

11.2 By booking the tour, the client acknowledge the proposed itinerary and certify that he/she meets the required level of physical fitness and health.

11.3 Anti-malaria precautions are recommended for all tours and clients are advised to bring insect repellent.

12. Onward Travel Arrangements
12.1 Guts recommends onward travel arrangements only for the day after the tour ends.

12.2 If the arrangements are made for the same day the tour ends, Guts will not be responsible for any resulting delays.

13. Age Restrictions
13.1 Guts does not impose an upper age limit. However, clients under 18 years of age must be accompanied by a guardian and booking will be accepted at management’s discretion.

14. Force Majeure
14.1 Unforeseen circumstances including weather, road conditions, war, mechanical breakdowns, riots and other reasons beyond Guts’s control may cause delays or alterations to the tour. In the event of any of the aforementioned circumstances, Guts shall not be held liable for any resulting costs of these delays or alterations.

15. Exclusion of Liability
15.1 Client bookings are accepted on the understanding by the client that all tours are of an adventurous nature and involve an element of personal risk that is an inherent part of travel in Africa.

15.2 Clients undertake all tours entirely at their own risk and while Guts takes every precaution to ensure the safety of the clients, Guts will not be liable for any death, injury or loss that might occur to such clients, sustained from any cause whatsoever.

15.3 The client and his/her dependants, heirs, executors, administrators or assigns, hereby indemnify and hold blameless Guts, its members, employees, representatives and agents from any claims of any nature and from any liability for delay, loss, damage, injury, illness or death arising from any cause whatsoever out of events related to or occurring during a tour.

15.4 The client agrees to strictly abide by the laws and regulations of each country visited.

15.5 Clients are responsible for checking in on time and are responsible for reconfirming flight times. Guts will not be responsible for delays caused by airline flight alterations, cancellations or delays.

15. 6 When you book excursions not operated by Guts (whether recommended by the company or not), Guts will have no legal liability for problems arising from the excursion and any claim will be against the relevant local operator (e.g. white water rafting, bungee jumping, Delta etc).

16. Photography
16.1 Guts reserves the right to make use of any photograph or film produced by Guts without notice, payment or permission.

17. Complaints
17.1 While on tour, clients should bring any complaints to the guide’s attention immediately.  If the matter is not resolved during the tour, Clients must address the complaint in writing within 30 days of completion of the tour. Guts will not entertain complaints of loss of enjoyment where full land arrangements have been provided.
